Time Freeze Membership Details

Ongoing and Fixed membership types can be frozen for a maximum of 56 days per year, for a minimum of seven days for each freeze. Flexi membership types can be frozen once per year for a maximum of 30 days per year, for a minimum of seven days for each freeze.

Freeze length entitlements are calculated from your membership anniversary date. You will be charged an administration fee of $0.45 +GST per day of your freeze when your request is processed.

Freezes are not available on short term or promotional memberships.

Membership Terms and Conditions 

  1.  General
    1.1.  Your membership is valid from the commencement date set out in your Membership Agreement (or if no date is set out, the date we accept your application for membership). You are entitled to view the Craigie Leisure Centre premises and facilities before entering into a Membership Agreement.
    1.2. You must adhere to the Craigie Leisure Centre Conditions of Entry, displayed at the entrance to and throughout the facility and these are incorporated by reference into these terms and conditions. We reserve the right to refuse entry or to remove you from the facility, if you fail to comply with the Conditions of Entry.
    1.3. You must be at least 13 years of age to become a member (11 years for pool access membership). A parent/guardian must sign your Membership Agreement if you are aged 11-15 years. A parent/guardian must co sign your Membership Agreement if you are aged 16-17 years. Members under the age of 16 years must be accompanied by a parent/guardian at all times and must pay the costs associated.
    1.4. You are entitled to use the services as outlined under the membership type on your Membership Agreement. If you do not use all, or part of, the range of services under your membership type you must still continue to meet the responsibilities under your Membership Agreement, including the payment of your membership fees. 
    1.5. You will be required to have your photo taken upon joining, which will be stored in our digital membership database.
    1.6. We will communicate with you via email, SMS and our monthly e-newsletter.
    1.7. You are responsible for advising us of any change of name, address, account details or circumstance in writing. Documentation verifying a name change is required.
  2. Membership Minimum Term
    2.1.  All memberships have a minimum contractual term:
    2.1.1. Fixed term memberships are 12 month fixed terms
    2.1.2. Ongoing memberships have a 12 month minimum term
    2.1.3. Ongoing Flexi memberships have a 30 day minimum term
    2.2. Those aged under 18 years are not subject to a minimum term.  Once you turn 18 years of age, the standard membership terms and conditions will apply and the minimum term will be applicable. 

  3. Ongoing Memberships
    3.1. After the minimum term ends, your nominated account will continue to be debited until we receive notification of cancellation in accordance with section 5.0.
    3.2. Ongoing memberships will continue until either you or we terminate the Membership Agreement in the way described in this document. If an automatic debit arrangement is in place, membership fees will continue to be debited from your credit card or account until you or we cancel the arrangement by notifying your bank or credit provider. If you terminate the arrangement or stop the automatic debit arrangement in a manner not described in the  Membership Agreement, then you may be liable to us for damages for breach of contract.
    3.3.If you wish to cancel your membership immediately at the end of the minimum contractual term, you will need to lodge your membership cancellation request at least 30 days prior to the end of the term, as outlined in section 5.0.
    3.4. Ongoing memberships will not automatically expire at the end of your minimum contractual term. Direct debit payments will continue to be debited from your account until we receive notification of cancellation in accordance with section 5.0.

  4. Cooling Off Period
    4.1. You have a seven-day cooling-off period from the date you sign your Membership Agreement. You may cancel your membership during the cooling-off period without penalty. A refund of your pro-rata payment will be provided upon a written cancellation request provided to the City of Joondalup, Craigie Leisure Centre, less the cost of any facilities attended during this cooling off period.
    4.2. To cancel during your cooling off period, you must complete the online request form on the Website.
    4.3. Your cooling off period starts on the day you sign your Membership Agreement and ends seven days from this date.
    4.4. We have seven days to respond to your request.

    5. Cancelling Your Membership
    5.1. You must provide 30 days’ notice if you wish to cancel your membership. To cancel your membership, you must complete the online request form on the Website. Any fees due in this 30-day notice period will be charged as per normal. We have seven business days to respond to your request.
    5.2. To avoid cancellation fees, you must complete the minimum term of your membership as set out in your Membership Agreement.
    5.3. If you choose to cancel within your minimum term you will be required to pay a cancellation fee. Your cancellation fee will be equal to 90% of the remaining balance of your minimum term.
    5.4. If you fall under our fair cancellation criteria you will not have to pay a cancellation fee. Our fair cancellation criteria is set out as follows:
    5.4.1. Moving Away – provide proof of your new address if you are moving outside of a 10km radius of Craigie Leisure Centre. Proof must state your full name (for example driver’s license, house lease or purchase agreement).
    5.4.2. Sick or incapacitated for 90 days or more. You will be required to provide a certificate from a qualified medical practitioner stating that you are unable to exercise. The certificate must include dates.
    5.4.3. Experiencing financial difficulty. Requests must be provided in writing including circumstances and supporting evidence. The decision will be based on management’s absolute discretion.
    5.5. Supporting documentation is required to accompany your cancellation request for any of the reasons listed above. Details of other accepted documents may be published on the Website from time to time.
    5.6. Cancellations may be requested by completing the online request form on the Website.

    6.  Transferring Your Membership
    6.1. To transfer your membership to someone else, you must complete an online request form on the Website. You must provide seven business days’ notice and an administration fee of $15.00 is applicable.
    6.2. The transferee:
    6.2.1. Must not be a current member;
    6.2.2. Must complete a new Membership Agreement;
    6.2.3. Must be eligible to take up your membership or pay the difference (for instance, you cannot transfer a discounted membership to someone who is not eligible for the discount); and
    6.2.4. Must not have been previously banned from the Craigie Leisure Centre or have failed to pay membership fees.
    6.3. To change your membership type, you must complete an online request form on the Website. You must provide seven business days’ notice and an administration fee of $15.00 is applicable for moving to a lower priced membership.

    7. Freezing Your Membership
    7.1.  You must give us notice of seven business days if you wish to freeze your membership, by completing the online request form on the Website. Notice of less than seven business days may result in your next direct debit payment being processed at the full fortnightly amount.
    7.2. Ongoing and upfront term membership types can be suspended for a maximum of 56 days per year, for a minimum of seven days for each suspension period. Flexi membership types can be suspended once per 12-month period for a maximum of 30 days and a minimum of seven days.
    7.3. Freeze length entitlements are calculated from your Membership Agreement anniversary date. 
    7.4.You will be charged an administration fee of $0.45+GST per day of your freeze.
    7.5. Courtesy and extended membership freezes are available when you provide a medical certificate that advises against taking part in physical activity temporarily for less than 90 days.
    7.6. Membership freezes cannot be backdated unless you present exceptional circumstances to us in writing.
    7.7. Backdating of your freeze will be based on our absolute discretion.

    8. Renewing Your Membership
    8.1. Refer to section 3.0 for ongoing memberships.
    8.2. Upfront term memberships can be renewed up to 30 days prior to the expiry date. The most up-to-date fees and charges will apply as well as any promotion running at time of renewal.

    9. Membership Discounts
    9.1. Eligible customers who are full-time students, seniors, or have a pension card are entitled to a 25% discount on memberships. Seniors aged 75 and over are entitled to a 33.33% discount on memberships.
    9.2. The City’s endorsed concession guidelines apply to cards issued by the State and Commonwealth Governments and proof of entitlement is required.
    9.3. Only one discount can be applied to a membership at any given time.
    9.4. Proof of entitlement must remain valid throughout the membership term. If your proof of entitlement expires during the membership term, updated documentation will be required to maintain the discount to your membership fee. If you fail to provide valid current proof of entitlement, your membership fee will be adjusted to the full membership fee, as you will be deemed no longer eligible.

    10. Outstanding Fees
    10.1.We will suspend your account as soon as the bank or payment provider has informed us that a payment has defaulted. We will notify you by SMS and/or email when a payment has defaulted.
    10.2. You will be charged a $15.00 administration fee each time a payment defaults. This is in addition to your outstanding fees.
    10.3. If you fail to contact us or bring your account up-to-date within 14 days of receiving your notification, we may begin to take action to recover your outstanding fees.
    10.4. If your fees remain unpaid for longer than 28 days, we have the right to cancel your membership with your outstanding fees and remaining balance owed (as set out in section 5.3).
    10.5. You may incur additional fees if your outstanding fees are passed to a third party to collect on our behalf.

    11. Price Increases and Changes to Membership
    11.1.You will be given a minimum notice of 14 days of any changes to the price or structure.
    11.2. All efforts will be made to notify you in writing dependent on current database contact details, as well as email, the Website and facility signage.
    11.3. If you do not agree with a material change to the price or structure of the relevant membership, you may terminate your membership as outlined in section 5.0 without incurring a cancellation fee.
    11.4. You have 14 days from the notification of the fee change to submit a request to cancel, otherwise you will be considered to have accepted the updated prices.

    12. Change of Rules, Terms and Conditions
    12.1. We reserve the right to change, modify or update rules and/or terms and conditions relating to your membership or use of the Craigie Leisure Centre.
    12.2. You will be given a minimum notice of 14 days of any changes to the rules and/or terms and conditions.
    12.3. All efforts will be made to notify you in writing dependent on current database contact details, as well as email, the Website and facility signage.
    12.4. If you do not agree to a material change, modification or update to the rules and/or terms and conditions relating to your membership or use of the facilities, you may terminate your membership by following the cancellation procedure outlined in section 5.0 without incurring a cancellation fee.
    12.5. You have 14 days from the notification of the fee change to submit a request to cancel, otherwise you will be considered to have accepted the updated terms and conditions.
    12.6. We will not reduce your membership fees or freeze your membership due to the Craigie Leisure Centre being closed for renovations or for a public holiday. However if we suspend the operations or services of the Craigie Leisure Centre, we may provide you with an alternative at our discretion.

    13. Direct Debit Payments
    13.1. You agree to the Terms and Conditions set out in the Debitsuccess Pty Limited (ACN: 095 551 581) (Debitsuccess) Direct Debit Request (DDR) Service Agreement available below.

    14. Liability
    14.1. By signing or entering into a Membership Agreement, you:
    14.1.1. Are declaring you are medically and physically able to participate in physical activity, and understand and accept the inherent risks of undertaking exercise.
    14.1.2. Acknowledge and agree that you enter our premises and surrounds and/or participate in programs, utilise the equipment and/or take advantage of services offered by us absolutely at your own risk.
    14.2. Acknowledge and agree that you release and discharge us from all liability for loss, damage or injury which you may sustain.
    14.3. You indemnify us to the extent permitted by law in respect of any claim by any person arising as a result of or in connection with your membership and/or participation in any of our activities. This release and indemnity shall not apply to the extent that the loss, damage or injury which is the subject of the claim is caused, or contributed to, by the negligent act or omission by us.

    15. Privacy
    15.1. Your personal information will only be used in accordance with our general business objectives and to provide you with our services, including to facilitate direct debit payments as set out the Direct Debit Request.

    16. Membership Access
    16.1. Membership access will be issued to all new members at the time of entering into a Membership Agreement. If you lose or damage your card, you will be charged a replacement fee for each replacement card.
    16.2. You are not permitted to share or distribute your membership access details or allow anyone else to access the facility using your membership. If you are found to be sharing your access details, your membership may be suspended or terminated as per Section 17.
    16.3. You must present your membership access at Craigie Leisure Centre to gain entry each time you visit. If you forget your card on more than three occasions you may be charged for a new card before being permitted to enter.

    17. Termination of Membership By Us
    17.1. We may terminate your Membership Agreement in the following circumstances:
    17.1.1. If you commit a serious or repeated breach of your Membership Agreement or Conditions of Entry;
    17.1.2. If any part of your membership fee remains unpaid 28 days after its due date for payment as set out in section 10.
    17.1.3. If you provide us with details which you know to be false, when applying for your membership and the false declaration would have reasonably affected our decision to grant you a membership.
    17.1.4. If you share or distribute your membership access with any other person to enable them access to Craigie Leisure Centre.
    17.2. If we terminate for any of these reasons, we reserve the right to retain a proportion of the money which you have paid us under the Membership Agreement to cover any reasonable costs we have incurred as a result.
